对不正当使用电子资源人员的处理决定
(English Version) 虽然图书馆反复提醒广大校内用户要合理使用图书馆订购的电子资源，以维护广大校内用户的合法权益及清华大学的良好声誉，但仍有个别用户我行我素。
2005年5月23日，计算机系教师金奕江指导学生作毕业设计时，管理不严，发生违规使用ACS数据库的事件，致使图书馆受到出版商的警告，并冻结了该IP（166.111.249.135）对ACS的访问权限。
他的行为不仅影响了许多师生正常使用该电子资源，也败坏了清华大学的声誉，给我们今后电子资源的建设和发展造成困难。经图书馆领导教育后，他已认识到问题的严重性，承认了错误，并写了检讨书。
为严肃纪律，教育本人，经清华大学图书馆馆务会议决定，对金奕江的违规行为作如下处理：
金奕江，计算机系教师 2001990220：通报批评，停借半年，冻结网络帐号。 近几年，校图书馆为了更好地服务于学校建设世界一流大学的战略目标，出巨资购买了大量的电子资源，较好地保证了学校教学、科研和学科建设对信息资源的需求，受到广大师生的欢迎。外国电子资源出版公司十分重视对知识产权的保护，而且都有严格的监控措施和技术手段。作为世界知名大学的清华大学师生，应该有相应的素养和意识。但遗憾的是，经常有个别人为了一己私利，不顾后果，采取不正当的方法和手段使用电子资源。其结果损害了广大师生的利益，也败坏了学校的声誉。为此，校图书馆再次重申：
1.不得使用任何工具软件下载图书馆购买的电子资源；
2.不得连续、系统、集中、批量下载文献，也不得将所获得的文献提供给校外人员，更不允许利用获得的文献资料进行非法牟利；（由于各数据库商对'滥用'的界定并不一致，因此图书馆无法制订统一标准。一般数据库商认为，如果超出正常阅读速度下载文献就视为滥用）；
3.校内任何单位和个人，如设置相应的代理服务器，一定要事先得到图书馆允许，并且保证该服务器不得允许校园外IP通过它访问图书馆购买的电子资源；
4.如发现违规行为，图书馆将协助学校有关部门进行追查。对违规者将视其情节轻重，予以相应的处罚，情节严重者，将报请学校予以纪律处分。由此而引起的法律上的一切后果由违规者自负。 清华大学图书馆

The Punishment Decision Against The Electronic Resource Abusers
In order to protect the legal rights of authorized users and to save the reputation of Tsinghua University, the library has appealed to the campus users to utilize the library-subscribed electronic resources legally. However, a small number of individuals utterly disregarded the intellectual property regulations and abused the library electronic resources. Due to the consecutive and systematic over-downloading of AIP full-text within short intervals by Jin Yijiang (Instructor) on 23 May 2005, the library received a warning from the publisher and the very IP addresses(166.111.249.135) was suspended to access ACS. His regardless behavior not only hindered the public use of electronic resources, but also damaged the reputation of Tsinghua University. With the help of our librarians, He has now convinced of their errors and submit written self-criticisms. To tighten up the library disciplines as well as to educate the violator, the library decides to take the following actions against the above violator:
Jin Yijiang:
1. Criticize on library website and report to the academic department and university Committee concerned.
2. Borrowing privilege from the library is suspended for six months.
3. Suspend his network acount.
The library would like to restate here that --
1.Any downloading of the library-subscribed electronic resources by any software tools is prohibited.
2.Any systematically over downloading full-text documents from library-subscribed databases is prohibited.
3.Any redistributing electronic literatures to non-Tsinghua users and any use of these electronic literatures for the purpose of making profits are prohibited.
4.Without the prior permission of the library, neither organization nor individual has the right to provide non-Tsinghua users to access the library-subscribed electronic resources via proxy server. If there is any serious violation of the above rules, the library will make a thorough investigation together with university departments concerned. The violator will be punished and will be reported to the university. All the legal consequences and liabilities shall be taken by the violator himself. Tsinghua University Library
